1. Use of the Service

a. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement.

b. Account Registration

You must create an account via Supabase authentication (email/password or Google OAuth) to access certain features.

You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

c. Acceptable Use

You agree to:

Use the Service for lawful purposes only.

Upload only images you have the right to use for 3D model generation.

Not interfere with the Service's functionality (e.g., via hacking, DDoS attacks, or excessive API calls).

2. Service Features

a. Freemium Model

Free Plan: Limited lifetime 3D model generations using basic models (e.g., Light). Free users start with 1 credit.

b. Paid Model

Paid Plans: Limited monthly generations, access to advanced models, and additional features for a subscription fee via Stripe.

c. Credit Packs

Credit Packs: Set number of generations added to users account, access to advanced models, and additional features for a one-time fee via Stripe.

d. 3D Model Generation

The Service uses Fal AI to generate 3D models from uploaded images.

Generated models are your responsibility; ensure you have rights to the input images.

e. Intellectual Property

Your Content: You retain ownership of uploaded images and generated 3D models, subject to the licenses below.

License to Us: By uploading images, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and use them solely to provide the Service (e.g., generate 3D models via Fal AI).

Our Content: The Service, including its UI, code, and sample 3D models, is owned by MakeIt3D and protected by intellectual property laws. You may not copy, modify, or distribute it without permission.

3. Community Gallery & User-Generated Content

a. Opt-In Sharing

By default, all generated 3D models are private — they are visible only to you. You may choose to share individual models to the public Community Gallery (/explore) at any time using the share toggle in your model history. Sharing is entirely voluntary.

b. Creative Commons License for Shared Content

When you opt in to sharing a model to the Community Gallery, you agree to release that model (including any associated preview image and prompt text) under the Creative Commons Attribution 4.0 International License (CC BY 4.0). This means:

Anyone may download, use, adapt, and distribute the model for any purpose, including commercially.

Attribution to MakeIt3D (as the platform of origin) is required.

You cannot revoke this license for copies already distributed, but you may remove the model from the public gallery at any time by toggling it back to private.

By sharing a model you confirm that:

1. You own or have the right to share the input image used to generate it. 2. The model does not infringe any third-party copyright, trademark, or other intellectual property rights. 3. The model does not contain harmful, offensive, defamatory, or illegal content.

c. Privacy Options

You have full control over the visibility of each model:

Private (default): The model is visible only to you. No one can access it without a direct share link you personally provide.

Shared link: A model with a `public_id` can be viewed by anyone who has the direct `/m/[publicId]` link, but it will not appear in the public Community Gallery unless you also enable Community sharing.

Community (public): The model appears in the public Community Gallery and is licensed under CC BY 4.0 as described above.

You can switch between these states at any time from your model history.

d. Moderation

We reserve the right to remove any shared content that violates these Terms, applicable law, or community standards, without prior notice.

4. Payments and Subscriptions

Payments: Pro plan subscriptions and usage-based billing are processed via Stripe. You agree to Stripe's terms for payment processing.

Refunds: Refunds are handled case-by-case. Contact us at hello@makeit3d.app for requests.

Cancellation: You may cancel your Paid plan subscription at any time via your account settings. No further charges will apply after cancellation.

5. Third-Party Services

The Service relies on third-party providers (e.g., Supabase, Fal AI, Vercel, Stripe). We are not responsible for their availability or performance. Review their terms and policies.

6. Termination

By You: You may stop using the Service and delete your account at any time.

By Us: We may suspend or terminate your access for violating these Terms, non-payment, or misuse of the Service.

Upon termination, your private generated models may be deleted. Models previously shared to the Community Gallery under CC BY 4.0 remain available to those who have already downloaded them, but will be removed from the gallery.

7. Disclaimer of Warranties

The Service is provided "as is" without warranties. We do not guarantee:

Uninterrupted or error-free operation.

The accuracy or quality of generated 3D models.

The availability of third-party services (e.g., Fal AI).

8. Limitation of Liability

To the fullest extent permitted by law, MakeIt3D is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including loss of data or profits.

9. Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. Disputes will be resolved in the courts of the Czech Republic.

10. Changes to These Terms
